Limitation of Liability

Our services provide technology for outbound calling, voice agents, and lead engagement. We do not provide or source lead lists. Clients are solely responsible for ensuring that all leads uploaded or contacted through our system have provided valid consent in accordance with applicable laws (e.g., TCPA, GDPR, CASL, PECR). By using our service, you acknowledge and agree that you are the lawful controller of any data you upload and that all contacts are fully opt-in.

Use of the Term "Cold Calling" And Limitation of Liability

The phrase “cold calling” as used on this website is a general industry term to describe outbound calling by AI agents. It does not imply or permit calling individuals without prior consent. Our platform acts as a software provider only and does not assume liability for how clients choose to engage with uploaded leads.

We disclaim all liability for client misuse of lead data. Any legal claims, fines, or penalties arising from unlawful use of lead lists remain the sole responsibility of the client.

Indemnification

You agree to indemnify and hold SkyAutomation harmless from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

Termination

We may terminate or suspend your account and access to our services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
